Cipher case is a criminal case, the prosecution has to prove its case, Chief Justice Islamabad High Court

Islamabad High Court Chief Justice Amir Farooq has said that the cipher case is a criminal case, in a criminal case the prosecution has to prove its case.

The Chief Justice of the Islamabad High Court made these remarks during the hearing on the appeals against the conviction of founder PTI and Shah Mehmood Qureshi in the cipher case.

He said that he was tired of asking what was in this sealed envelope. Which country benefited indirectly?

Amir Farooq further said that if everyone says that the night has come, then the night will not come? If everyone is saying that the relationship has gone bad, then it will not happen like this.

During the hearing, Justice Mian Gul Hasan Aurangzeb said that what was in the cipher that manipulated the information? The PTI founder said that the cipher said that if it is not removed, there will be consequences.

He inquired that this was the text of the cipher that there will be consequences if the founder PTI is not removed. Are you saying what PTI founder said was right? Was the PTI founder telling the truth?

To this, FIA prosecutor Hamid Ali Shah replied that this was exactly the message, the PTI founder himself admits.

On this, Justice Mian Gul Hasan Aurangzeb said that you should leave it and tell yourself what was changed.

On this, Chief Justice Amir Farooq said that Shah Sahib is not like that, you are talking about a civil case, this is a criminal case, in a criminal case, the prosecution has to prove its case.

He further remarked that even if the accused admits himself, the prosecution does not have to prove the case, admission does not mean that the prosecution is discharged.

On this occasion, Justice Mian Gul Hasan Aurangzeb said that the cipher could be of 100 pages or one paragraph, we don’t know, the trial court doesn’t know, the prosecution doesn’t know, while the FIA ‚Äč‚Äčalleges that Bani Pt. I manipulated the cipher.

The judge of the High Court further said that you are saying, he made the correct text of the cipher public, then what manipulation happened?

The court also summoned the lawyers provided by the government to the accused on this occasion and directed that the state counsels who were officially appointed as the lawyers of the accused should also appear tomorrow.

The Islamabad High Court adjourned the hearing on the appeals against the conviction in the cipher case till tomorrow.
