Order to convene KP Assembly meeting and administer oath to newly elected members within 14 days

Peshawar: The Peshawar High Court ordered the Chief Minister Khyber Pakhtunkhwa to convene a meeting of the Assembly within 14 days and the Speaker to administer oath to the newly elected members before the Senate elections.

The Peshawar High Court has issued a detailed judgment of the case, which consists of 24 pages, written by Justice SM Atiq Shah, in the matter of non-swearing of newly elected members on certain seats in Khyber Pakhtunkhwa Assembly.

In a detailed decision, the court has ordered the Chief Minister of Khyber Pakhtunkhwa and the provincial cabinet to take steps to convene the assembly meeting. Before these newly elected members are to be sworn in, the Speaker shall administer oath to the newly elected reserved seat members of the KP Assembly.

The court has said that it is a violation of the constitution to prevent the newly elected members from taking oath on certain seats. The Election Commission declared the PTI intra-party elections invalid. After the victory, the PTI Azad members joined the Sunni Ittehad Council.

In the detailed decision, it has been said that the Election Commission rejected the application filed for the specific seats of the Sunni Ittehad Council on March 1. An application was filed in the Peshawar High Court. The larger bench of the Topshawar High Court dismissed the application of the Sunni Unity Council on March 14.

In the detailed judgment, it has been said that the governor convened a meeting on March 22 at 3 o’clock to administer oath to the elected members on specific seats, the speaker did not convene the meeting, so the petitioners approached this court.
