Supreme Court; Request for regularization of JSMU contract employees rejected

Karachi: The Supreme Court rejected the petition regarding regularization of 600 contract employees of Jinnah Sindh Medical University.

A hearing was held on the application related to the regularization of 600 contract employees of Jinnah Sindh Medical University in front of a bench consisting of Justice Jamal Khan Mandukhel and Justice Naeem Akhtar Afghan headed by Chief Justice of Pakistan Justice Qazi Faiz Isa.

Umar Soomro, counsel for the petitioner, submitted that the Cabinet had approved the regularization of these employees, but they were dismissed.

The Chief Justice remarked that how can the Cabinet approve regularization? State if the law permits regularization. It’s not a matter of policy, it’s a matter of breaking the law, just tell me what the law says.

Chief Justice Qazi Faiz Isa said that tell me where it is written in the constitution that the cabinet is above the law? Sindh Assembly should make the law, they have the authority, then keep regularizing under the law.

The lawyer said that there is a law for regularization of university employees in the rules of business, on which the chief justice remarked that do not call the rules of business the law of appointment and regularization, it will not apply here.

Justice Jamal Khan Mandukhel while giving remarks said that the condition of government institutions is very bad, recruitment is being done only on contract basis. The Chief Justice remarked that the PIA has been filled with so much staff that the burden continues to increase. Justice Jamal Khan Mandukhel said that there should be a ban on ad-hoc recruitment for more than 6 months in all universities of Pakistan.

The petitioner’s counsel submitted that you order to start the regularization process. Chief Justice Qazi Faiz Isa remarked that we will not do the work of the government and we will not do the work of the parliament either.

Later, the Supreme Court rejected the plea of ​​the employees of Jinnah Medical University.
