Decision reserved on Bushra Bibi’s transfer request to Adiala Jail

On the order of the Ministry of Home Affairs, the Chief Commissioner issued an illegal notification for the transfer of Bani Gala Sub Jail, argued the lawyer

Islamabad: The Islamabad High Court reserved its decision on the request to transfer Bushra Bibi from Bani Gala to Adiala Jail.

In the High Court, a hearing was held on the transfer request of Bushra Bibi from Bani Gala Sub Jail to Adiala Jail.

Bushra Bibi’s lawyer said that Bushra Bibi was convicted in the Tosha Khana and Idt Nikah cases, after the conviction a warrant of arrest is issued which goes to the superintendent of jail, Bushra Bibi is not present in the court at the time of sentencing. He surrendered himself, after which he was transferred to Bani Gala Ghar as a sub-jail on the order of the Chief Commissioner.

The lawyer argued that Bushra Bibi went to Adiala Jail as per the order of the trial court which was sent to the Superintendent of Adiala Jail, later on the order of the Ministry of Home Affairs the Chief Commissioner issued an illegal transfer notification, Adiala Jail made Gala Sub. There was no instruction from the concerned authorities regarding the transfer of the jail, the notification issued by the Chief Commissioner was not the instructions of the concerned authorities i.e. the Superintendent of Adiala Jail, neither the provincial government issued any such instruction nor the IG Jails nor any instruction. Chief Commissioner’s notification of transfer of Bani Gala Sub Jail is illegal.

Justice Mian Gul Hasan Aurangzeb after hearing the arguments reserved the decision of the case.
