Justice Babar to recuse himself from the audio leaks case, four organizations filed a separate petition

To meet the demands of justice, Justice Babar Sattar excused from the hearing, Pemra

Islamabad: In the Audio Leaks case, four organizations have filed a separate application in the Islamabad High Court, arguing that the second bench has already decided on this type of application.

In the miscellaneous petition, it was said that in order to avoid a conflicting decision, Justice Babar Sattar, who heard the petitions of Bushra Bibi and Najam-ul-Thaqeeb, should be separated from the case and the trial of this case should be continued by the same bench that had previously heard the other petition of the same nature in 2021. I have decided.

An important development has come out in the audio leak case being heard in the court of Justice Babar Sattar of Islamabad High Court. PEMRA, PTA, FIA and IB filed a separate application.

The position adopted in the application has been previously decided by Justice Mohsin Akhtar Kayani in another similar case in 2021. Therefore, to avoid a conflicting decision and this is the requirement of justice, Justice Babar Sattar, who heard the petitions of Bushra Bibi and Najam-ul-Thaqeeb, should recuse himself from this case.

It has been requested from the court that not only Justice Babar Sattar should refuse to hear this case, but also the second bench which decided on the same type of application should proceed with the proceedings of this case.

It has been stated in the petition that Chairman Pemra has appeared in court several times but the case is still under hearing.

Bushra Bibi has challenged the leaked audio with her lawyer Sardar Latif Khosa Advocate, while former Chief Justice Saqib Nisar’s son-in-law Najam Al Thaqib has challenged the summon notification in the parliamentary committee formed on the audio leak.

Justice Babar Sattar is hearing both the petitions together. The audio leak case is scheduled for hearing on April 29.
