Supreme Court’s order to end encroachment from roads and footpaths across the country

Federal and provincial governments to remove encroachments from roads and footpaths in 3 days, court

Karachi: The Supreme Court has issued a written order regarding the encroachments that the federal and provincial governments must remove the encroachments from the roads and footpaths within three days.

A three-member bench headed by Chief Justice Qazi Faiz Isa issued a written order on the encroachment petition. In the written order, it was said that pedestrians are facing problems due to containers on the roads of Karachi. The court ordered to remove the container by hand.

The written order said that the containers were brought and the road blocked. But later the containers were removed and placed on the footpath or roadside. Pedestrians have the right to freedom of movement, there should be no obstruction to movement. No permission will be given to block footpaths for long periods and obstruct pedestrians.

The court also ordered the local bodies to file an application saying that many trees have rotted on many roads but new ones have not been planted. Climate change can be combated by increasing trees. Oxygen supply and carbon dioxide may decrease.

The Supreme Court has ordered to end encroachments from roads and footpaths across the country. The court ordered a copy of the order to be sent to the Attorney General, all Advocate Generals and all government agencies.

The court ordered Pemra to publish and broadcast a public service message in this regard, asking the federal and provincial governments to end the encroachment on roads and footpaths within 3 days. The concerned authorities should do this at the expense of the occupiers. Additional Attorney General, Advocate General and KMC counsel submit implementation report.

The written order said that the occupier considered that it was his right to occupy the front of his property. People have even installed generators on the footpaths. Federal and provincial governments have also established encroachments. No one has the authority to stop the free movement of citizens.

According to the written decree, no one can take away the rights of the tax-paying public for government expenditure.

Additional Attorney General and Advocate General Sindh said that the barriers have been erected due to terrorist attacks. Unfortunately, the idea has grown that they have a right to the open space or garden around the building.

Regarding the trees, the Supreme Court has said in a written order that new trees should be planted in place of the dead trees on the footpaths and other places. Unfortunately, no steps have been taken by the administration regarding the maintenance of these trees.

The written order said that if trees were maintained along the roads, pedestrians could use them more. The local government is mandated to take better care of these trees. The local government should immediately conduct a survey and prepare a report in this regard.
